Acceptable use policy
By using our Subscription Services, you agree to comply with the following policy. If you permit any Affiliates to access and use our Subscription Services, you will also be responsible for their compliance with these requirements.
Any violation of this policy may result in account suspension, termination, or legal action. In the event of serious or illegal violations, we reserve the right to disclose breaches to relevant third-party authorities.
Capitalised terms used in this policy will have the meanings given in our Terms of Use.
You agree that neither you nor your Affiliates will engage in, or attempt to engage in, the any of the following:
1. Disruption of Subscription Services.
Do not, interfere with or disrupt the Subscription Services or others' use of them.
2. Illegal, harmful and prohibited content and images.
Do not use or access our Subscription Services for uploading, transmitting, posting or otherwise introducing any image or file that contains, depicts or promotes:
Abusive, obscene, indecent, pornographic or other offensive material.
Content that glorifies or incites violence, self-harm, or hatred
Spam, junk mail, or unsolicited or unauthorized advertising.
Hacking, password cracking, IP spoofing, or fraudulent activities.
Any material that is unlawful (including where material is libellous or offensive), violates applicable data protection laws (such as the General Data Protection Regulation; California Consumer Privacy Act; California Privacy Rights Act; Canada’s Personal Information Protection and Electronic Documents Act; South Africa’s Protection of Personal Information Act; or Australia’s Privacy Act), third-party intellectual property rights, or is otherwise deemed immoral or harmful.
We may use automated content moderation technology (including Microsoft Azure Content Safety) to scan images and files uploaded to or transmitted or posted through our Subscription Services. Images and files uploaded to or transmitted through tools within our Subscription Services (such as signature generators) may be scanned by third-party tools. Such scanning may involve the temporary processing of image and file data for the purpose of content classification. You are responsible for ensuring that any images or files you upload or transmit comply with applicable data protection laws, including obtaining any necessary consents from individuals whose personal data may be contained within such content.
We reserve the right to block, remove, or refuse to process any image or file that is flagged by content moderation tooling, without prior notice to you. Repeated violations, or the uploading of content that is flagged as seriously harmful, may result in account suspension or termination in accordance with this policy and our Terms of Use.
Child sexual abuse material (CSAM).
The upload, transmission, storage, or distribution of child sexual abuse material (CSAM) or child sexual exploitation material (CSEM) through our Subscription Services is strictly prohibited and constitutes a serious criminal offence in all jurisdictions in which we operate. This prohibition is absolute and cannot be waived or modified by any agreement between you and us.
We use PhotoDNA hash-matching technology (operated by Microsoft) to scan images and files processed through our Subscription Services for known CSAM. This scanning operates automatically and cannot be disabled or overridden. PhotoDNA does not enable us or Microsoft to view the content of images; it compares cryptographic hashes against a database of known CSAM maintained by recognised child protection organisations.
Where our Subscription Services detect content that matches known CSAM, we are required by law to report such content to the relevant national authority (including, as applicable, the National Center for Missing and Exploited Children (NCMEC) in the United States, the Internet Watch Foundation (IWF) in the United Kingdom, and equivalent bodies in other jurisdictions). We will also report such matters to law enforcement as required. By using our Subscription Services, you acknowledge that we have no discretion to withhold such reports once a match is detected, and you expressly consent to us making those reports and sharing associated account information with the relevant authorities.
Any account found to have uploaded, transmitted, or stored CSAM through our Subscription Services will be immediately and permanently suspended. We reserve the right to preserve and provide relevant data to law enforcement authorities in connection with any such detection.
3. Competing products or services.
Do not use our Subscription Services to create products or services that compete directly with our offerings or the underlying software.
4. Unauthorized access or copying.
Except as may be allowed by applicable law which in incapable of exclusion by agreement between you and us, do not:
Copy, modify, duplicate, create derivative works from, frame, mirror, republish, download, display, transmit or distribute any part of our Subscription Services or underlying software in any form or by any means.
Attempt to reverse-engineer, disassemble, or reverse compile or otherwise reduce to human readable form all or any part of our Subscription Services or their software.
License, rent, sell, lease, transfer, assign, distribute, display, disclose or otherwise commercially exploit or make available the Subscription Services or their software to any third-party without Our express written consent.
5. No encumbrances.
You must not allow our Subscription Services or their software to become subject to any lien, charge, or encumbrance.
6. Legal compliance.
Do not use our Subscription Services in a way that violates laws, including:
Data protection laws, regulations and codes of practice. You are solely responsible for the data you process through our Subscription Services.
Export control laws. You must not export or re-export the Subscription Services to any country, region, organisation or individual that would breach such laws.
Sanctions. You must not permit access to the Subscription Services to any organisation, individual, or within any country or region, that would breach such laws.
7. Custom fonts use.
If you upload custom fonts to our Subscription Services (or such fonts are unloaded on your behalf) for use in connection with the Subscription Services, you are responsible for ensuring that: (i) such uploading and use does not breach the terms of any licence that you have in place in respect of your use of such custom font; and (ii) you have a licence covering your use of such fonts throughout your use of them within our Subscription Services. Do not upload such fonts (or use such fonts) unless you have secured and maintain the necessary licence to do so.
8. Automated systems and bulk emailing.
Do not use our Subscription Services in connection with automated mailing systems or to send bulk emails that violate anti-spam laws. You are responsible for ensuring that any marketing activity or automated mailing use complies with applicable laws, industry regulations or other codes of practice (including those related to data privacy and consent).
9. Trademarks and intellectual property.
Unless we have given you written permission, you must not use our trademarks (which include the word Exclaimer and our logo) or our other intellectual property rights.
Do not use our Subscription Services to misuse, interfere with or infringe others intellectual property rights. By way of example, this includes not copying other’s work, using it without their permission or misrepresenting your rights to use materials. Essentially, like with our intellectual property – if you do not have the owner’s permission to do something with it, do not use it when using our Subscription Services.
